Major Victory for Individuals Denied Social
Security Benefits
If your Social Security,
Supplemental Security Income (SSI), or Special
Veterans Benefits (SVB) were suspended due to a
felony arrest warrant, a recent class action
settlement may offer relief and reinstatement.
Last September, the United States District Court
in the Northern District of California approved
a nationwide class action settlement agreement
in the case of Martinez v. Astrue.
Between
200,000 and 800,000 people nationwide may
benefit from the settlement. Thousands here in
Pennsylvania may be eligible to have their
Social Security benefits reinstated and receive
back payments, as a result of this settlement.
The lawsuit settlement stopped the Social
Security Administration (SSA) from illegally
denying benefits to people with most types of
open bench warrants, and from collecting
overpayments due to most warrants. SSA’s
practices resulted in the loss of benefits for
many innocent elderly and disabled applicants,
as well as many whose warrants were not intended
by the law to terminate benefits.
The SSA began sending notices to affected
beneficiaries in May - many of whom must respond
within six months in order to have their
benefits reinstated and to claim back benefits.
